ATISDA Good-Standing FAQs
What is the latest update on ATISDA?
During merger talks with another California-based T&I association this year, the ATISDA board learned that ATISDA has a suspended status with the California Franchise Tax Board, which means it has lost its powers, rights, and privileges, including the right to enforce legal contracts. The association was initially incorporated as a 501(c)(3) nonprofit organization, which is the classification for charitable entities (i.e., for public benefit). To regain good standing, we need to amend our Articles of Incorporation to be classified as a 501(c)(6) nonprofit organization, which is the proper classification for professional associations (i.e., for mutual benefit).
What are the implications for ATISDA?
ATISDA must file several forms and documentation with the appropriate federal and state agencies to amend its Articles of Incorporation and obtain tax-exempt status.
Does that mean ATISDA is still functioning as a nonprofit organization?
We will continue with our mission as soon as we can resume our activities, but to avoid any further missteps, we have decided to pause all activities.
How long will this process take?
Due to the bureaucratic nature of the procedures, we cannot predict a precise timeline. As we move through the process, we will have a better understanding of the timeline.
What does this mean for my membership?
Memberships and all activities will be reactivated when we receive approval from the appropriate agencies.
